Terms of Service (TOS)

1. Acceptance of Terms
By placing an order with Magnetify Pics (via our website), you agree to be bound by these Terms of Service and our Privacy Policy.

2. Customer Representations and Warranties

  • You affirm that you are at least 18 years old and have the legal right to upload and use the photos or artwork submitted.

  • You confirm the content does not violate third-party rights (copyright, privacy, defamation, etc.).

  • You grant Magnetify Pics a non-exclusive, worldwide, royalty-free license to use the submitted photos or artwork solely for the purpose of producing, printing, and shipping the ordered products, and for any quality control or customer-service purposes.

3. Payment and Order Processing
Standard e-commerce terms - payment must be completed at checkout. Orders may be subject to approval or rejection by us.

4. Shipping, Returns & Warranty
As per our existing policy: lifetime replacement for worn or damaged prints, first-time production defects, etc.

5. Intellectual Property
All rights to the photos remain with you. We only print and deliver based on your submission; we do not claim ownership of your images.

6. Limitation of Liability
In no event will Magnetify Pics, its officers, employees, affiliates, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of data or photos, loss of profits, emotional distress) arising out of or related to your use of the service, even if advised of such possibility. Our total liability is limited to the amount paid for the specific order in question.

7. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs or expenses (including legal fees) arising from your breach of these Terms, including if you uploaded content you do not own or have permission to use.

8. Security and Data-Breach
We follow reasonable security practices, but you understand that no internet service is completely secure. We are not liable for breaches or unauthorized access, data loss or theft, or misuse by unauthorized third parties.

9. Governing Law
These Terms and any disputes arising from them shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
